OVERVIEW Welcome to Andersson Stone. The terms "we", "us" and "our" refer to Andersson Stone, a trading name of Cavaier AB (org. no. 559267-9541), Birger Dahlerus Väg 12, 176 69 Järfälla, Sweden. Andersson Stone operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Andersson Stone is powered by Shopify, which enables us to provide the Services to you.
The terms below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy (/policies/privacy-policy). If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access our Services. Nothing in these Terms limits your rights as a consumer under mandatory law.
SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your country of residence. To use the Services, including browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address and your billing, payment and shipping information. You confirm that all the information you provide is correct, current and complete.
You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.
SECTION 2 - OUR PRODUCTS We make every effort to show our products accurately. Colours and appearance may differ slightly on your screen depending on your device and its settings. Natural diamonds and gemstones are unique, and small natural variations between a piece and its images are normal.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer.
SECTION 3 - ORDERS When you place an order, you are making an offer to purchase. Your order is accepted when we send you an order confirmation. We may decline or cancel an order, for example if a product is unavailable or if there is an obvious error in price or product information. If we do so after you have paid, you will receive a full refund. We will contact you using the email, billing address and/or phone number provided with the order.
Your purchases can be returned in accordance with our Refund Policy (/policies/refund-policy). Your purchases are intended for your own personal use and not for commercial resale.
SECTION 4 - PRICES AND PAYMENT Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect when the order is placed and will be set out in your order confirmation email. Shipping costs are calculated at checkout. For orders delivered outside the EU, import duties and taxes may be charged by the destination country and are paid by the recipient.
Promotions may be governed by separate terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms apply.
You agree to provide current, complete and accurate purchase and payment information, and confirm that you are authorised to use the payment method you provide.
SECTION 5 - SHIPPING AND DELIVERY Orders are shipped from Sweden with DHL Express, fully insured and tracked. Delivery times are estimates and are not guaranteed. The risk of loss or damage passes to you when the order has been delivered to you. Read more in our Shipping Policy (/policies/shipping-policy).
SECTION 6 - RIGHT OF WITHDRAWAL If you are a consumer, you have the right to withdraw from your purchase within 14 days of the day you, or someone you name, receive the goods, without giving any reason (Swedish Distance and Off-Premises Contracts Act, lagen om distansavtal och avtal utanför affärslokaler). To withdraw, send us a clear statement, for example by email to , before the 14 days have passed. We will refund all payments received from you, including the standard delivery cost, within 14 days of receiving your withdrawal notice, using the same payment method you used. We may withhold the refund until we have received the goods back or you have shown that you have sent them. The right of withdrawal does not apply to goods made to your specifications or clearly personalised. This right applies to customers in all countries we deliver to, including Switzerland. SECTION 7 - WARRANTY Our products come with a 4-year warranty against manufacturing defects and a lifetime diamond guarantee, as described on our Warranty & Care page (/pages/warranty-care). This warranty is given in addition to, and does not affect, your statutory rights as a consumer, including your right to complain about faulty goods under the Swedish Consumer Sales Act (konsumentköplagen).
SECTION 8 - INTELLECTUAL PROPERTY Our Services, including all trademarks, brands, text, images, graphics, video and the design and arrangement of them, are owned by Andersson Stone, its affiliates or licensors, and are protected by copyright, trademark and other intellectual property laws.
You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any of the material on the Services without our prior written consent. Andersson Stone's names, logos, product names, designs and slogans are trademarks of Andersson Stone or its affiliates or licensors. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify.
SECTION 9 - OPTIONAL TOOLS AND THIRD-PARTY LINKS The Services may give you access to tools offered by third parties, and may contain links to third-party websites. We do not monitor or control these tools or websites and are not responsible for their content, products or services. Any use of them is at your own discretion, and you should review their terms and policies.
SECTION 10 - RELATIONSHIP WITH SHOPIFY Andersson Stone is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Andersson Stone (Cavaier AB). By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Andersson Stone, including any injury, damage or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Andersson Stone.
SECTION 11 - PRIVACY POLICY All personal information we collect through the Services is subject to our Privacy Policy (/policies/privacy-policy), and certain personal information may be subject to Shopify's Privacy Policy (). Because the Services are hosted by Shopify, information you submit will be transmitted to and shared with Shopify and with third parties that may be located in other countries, in order to provide the Services to you.
SECTION 12 - FEEDBACK If you send us ideas, suggestions, feedback or reviews ("Feedback"), you grant us a worldwide, royalty-free licence to use, reproduce, modify, publish and display that Feedback in any medium for any purpose, including commercial use. You confirm that you have the right to share the Feedback and that it does not violate the rights of any third party or contain unlawful, offensive or misleading content. We may, but are not obliged to, monitor, edit or remove Feedback.
SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS Occasionally the Services may contain errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct them and to change or update information at any time. If an error affects an order you have placed, we will contact you before processing it further, and you may cancel it for a full refund.
SECTION 14 - PROHIBITED USES You may use the Services for lawful purposes only. You may not use them to break any law, infringe our or anyone else's intellectual property rights, harass or harm any person, transmit false or misleading information, send spam, impersonate any person, upload viruses or malicious code, scrape or collect other people's personal information, or interfere with the security of the Services. We may suspend or close your account if you breach these Terms.
SECTION 15 - TERMINATION We may terminate your access to the Services at any time if you breach these Terms. Sections that by their nature should survive termination, including Intellectual Property, Feedback, Limitation of Liability, Governing Law and Privacy Policy, will continue to apply.
SECTION 16 - DISCLAIMER The information on the Services is provided for general information purposes. Except as expressly stated in these Terms, on our Warranty & Care page or as required by law, the Services are provided "as is" and "as available". This does not limit your statutory rights as a consumer, including your rights in respect of faulty goods.
SECTION 17 - LIMITATION OF LIABILITY To the fullest extent permitted by law, Andersson Stone and Shopify are not liable for any indirect or consequential loss, such as lost profits or loss of data, arising from your use of the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability towards consumers under mandatory consumer protection law.
SECTION 18 - INDEMNIFICATION You agree to compensate Andersson Stone, Shopify and our affiliates for any third-party claims, damages or costs, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.
SECTION 19 - SEVERABILITY If any provision of these Terms is found to be unlawful, void or unenforceable, it will still be enforced to the fullest extent permitted by law, and the rest of these Terms will remain in full force.
SECTION 20 - WAIVER; ENTIRE AGREEMENT If we do not exercise or enforce any right or provision of these Terms, this is not a waiver of that right or provision. These Terms and the policies referred to in them are the entire agreement between you and us regarding the Services and replace any earlier agreements.
SECTION 21 - ASSIGNMENT You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations under these Terms, provided that this does not reduce your rights as a consumer.
SECTION 22 - GOVERNING LAW, PLACE OF JURISDICTION AND DISPUTES These Terms are governed by Swedish law. If you are a consumer, this does not deprive you of the protection of mandatory rules of the law of the country where you live. The place of jurisdiction is Attunda District Court (Attunda tingsrätt), Sweden. If you are a consumer, you may also bring proceedings in the courts of the country where you live, where mandatory law gives you that right. Please contact us first if you have a complaint, so we can try to resolve it. If we cannot agree, consumers resident in Sweden may refer the dispute to the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN, ).
SECTION 23 - HEADINGS The headings in these Terms are for convenience only and do not affect their interpretation.
SECTION 24 - CHANGES TO TERMS OF SERVICE You can review the current version of these Terms at any time on this page. We may update these Terms by posting changes on our website. Changes do not apply to orders placed before the change was published.
